General Terms and Conditions

The following terms and conditions apply for all transactions and services of Dago-Red. Any verbal agreement needs written confirmation of Dago-Red. We reserve the right to change, modify or amend any part of the general terms and conditions.

Advice:

In certain countries of the European Union, for example Germany, the implementation of lottery drawings is illegal. Therefore, if you want to participate in a lottery drawing, please check your local legislation if you are allowed to participate before entering the lottery. Every person participating in a lottery drawing is doing so at their own risk. Dago-Red cannot be held responsible for any person’s violation of local laws or legislation. Every person participating in the lottery needs to approve the above before entering the lottery by confirming ‘Yes, I have read and accepted the general terms and conditions of Dago-Red’.

Every major person being full of age can buy any number of lots for every car on offer. Minors or persons placed under disability are not allowed to participate or buy lots.

From the start of the official sale of lots you can buy lots for every car on offer from our website. The purchase of lots means you are entering a legally binding contract with Dago-Red. You will firmly be assigned your purchased lot(s) after your money has been credited to the accounts of Dago-Red. For different payment methods please refer to our website.

You will have to make a separate purchase for every sale of lots and every single car on offer. You can purchase one or any number of lots for every car on offer. For availability of cars/lots please refer to our website.

After purchasing one or more lots every participant will receive an e-mail confirming the lot(s) purchased, the lot number(s) and the amount due for the transaction(s). The lot number(s) will become effective after the amount due has been credited to the accounts of Dago-Red. The lot number(s) consist of the first letters of the first and surname of each participant and a four digit number. The lot number(s) cannot be assigned to any other person. Every winner has to be identified by presenting their passport or any other official document before claiming their prize.

We guarantee correct executions of the sale of lots and will comply with any legal or regulatory requirement for gambling and lottery drawings.

A winner will be drawn after all lots for a car have been sold. Each winner has to give Dago-Red a formal, written agreement allowing Dago-Red to publish information about the winner to the public on their website and in the media as well as in general marketing channels.

The cars to be won when buying lots are new cars. There may be differences in colour and fittings as to what cars are published on the website of Dago-Red. These differences arise from country-specific fittings. The winner of a car will take over the car directly at the car dealer or a sub-dealer in his country. Any tax or duty occurring is included in the win.

Upon completion of the lottery drawing the winner will receive a notification by e-mail. This notification includes all details for receiving the win/car.

Should Dago-Red not be able to deliver the car in question for reasons that lie beyond Dago-Red  responsibility, the winner will receive an amount of money equal to the amount of all lots sold in this particular drawing. Generally the winner has the choice to decide between the car and the amount of money.

Should the winner opt to take out the money instead of the car, the winner must send Dago-Red a written statement to do so. This statement must be send immediately upon notification of the win. The statement should also state the winner’s bank account details in order to enable Dago-Red to transfer the money.

Should the winner or any legal successor not claim his win within 30 days upon notification of the win or within that period not contact Dago-Red, a new winner for this particular drawing will be determined within 21days. Everyone holding a valid lot will participate in the new drawing.

We commit ourselves and every company working for us to abide the protection of data privacy. Dago-Red treats customer’s details private and confidential. In no case will we sell or make data available to third parties.

We would like to point out that participating in the lottery drawing of Dago-Red is a form of gambling. Only major persons being full of age are allowed to participate. We would also like to point out the dangers of overuse or misuse of gambling. Dago-Red cannot be made liable in any way if a person addicted to gambling or in danger of becoming addicted suffers any personal, financial or any other consequences from their addictiveness.

With reference to our German customers we would like to point out that lottery drawings in Germany are illegal according to German legislation.

By buying lots and participating in our lottery every person automatically agrees to the general terms and conditions of Dago-Red.
